These Terms & Conditions apply to your use of the Property Motion website and any services you request, book or receive from Property Motion. By accessing the website, requesting a quote, or confirming a Booking, you agree to these Terms.
The Property Motion website and services are provided by PM Tech Ltd (trading as “Property Motion”), a company registered in England and Wales.
Registered office: 124 City Road, London, EC1V 2NX, United Kingdom
Companies House number: 17262375
Contact: hello@propertymotion.co.uk
Effective date: 4 August 2026
In these Terms:
Our Services are provided on a business-to-business basis. By booking a Service you confirm that you are acting for purposes relating to your trade, business, craft or profession (for example as an estate agent, letting agent, landlord, developer or property manager) and not as a consumer.
If you are booking as a consumer (an individual acting outside your trade or business), please contact us before booking so we can confirm the correct terms and any statutory rights that apply to you, including any right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing in these Terms is intended to limit or exclude your statutory rights as a consumer.
You must use our website only for lawful purposes. You must not misuse the website, attempt unauthorised access, disrupt security or performance, or copy website content for commercial use without our written permission. We may restrict or suspend access if the website is used unlawfully or abusively.
Any prices shown on the website, in messages or on social media are guide prices and may change. Actual Fees may vary depending on property size, location, access requirements, service scope and any add-ons requested.
All Services are subject to availability and scheduling confirmation. Quotes issued by email are valid for 30 days from the date of the quote unless we tell you otherwise.
Unless stated as VAT-inclusive, prices are exclusive of VAT and other applicable taxes, which will be charged in addition where they apply.
A Booking is only formed when we send you a written confirmation (by email or through the Property Motion dashboard) accepting your order. Any prior communication (quote, informal message, order request) does not by itself create a binding contract. The written confirmation, together with these Terms, forms the contract between us for that Booking.
Unless otherwise agreed in writing, Fees are payable in accordance with the payment terms shown in your Booking confirmation or invoice.
Deliverables and certificates are released once cleared payment has been received. We may hold Deliverables until Fees for that Booking are paid in full.
For business Customers, we reserve the right to charge interest and reasonable recovery costs on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998, currently at 8% above the Bank of England base rate.
Card, bank transfer and other payment methods are as shown at checkout or on your invoice. Payment processing is handled by our third-party payment providers; we do not store full card details on our systems.
Please tell us as early as possible if you need to cancel or reschedule a Booking. All cancellation and rescheduling requests must be sent to hello@propertymotion.co.uk or through the Property Motion dashboard.
The following charges apply, based on the time we receive your request:
Where a Booking involves a third-party provider (for example a Gas Safe engineer or EPC assessor), any additional cancellation fees imposed by that provider will be passed on to you at cost.
We may cancel a Booking without charge if we are unable to deliver the Service safely or lawfully. Where we cancel for other reasons, we will refund any Fees paid for the cancelled Services in full.
You are responsible for providing accurate property details and ensuring safe, lawful access at the agreed time. This includes entry instructions, keys or codes, parking arrangements, and any permissions needed for photography, media capture or engineer attendance (including tenant consent where required).
If we cannot complete a Service because access is not available, information provided was incorrect, the property is unsafe to work in, or for any other reason within your control, we may:
Where we do complete the Service but delivery is delayed due to circumstances within your control, we are not liable for the delay.
We will perform the Services with reasonable care and skill and, where a delivery timeframe is stated in your Booking confirmation, within that timeframe (or, if none is stated, within a reasonable period).
Where we use qualified third-party providers (for example EPC assessors, Gas Safe engineers, EICR contractors) to deliver part of a Service, we remain your point of contact and take responsibility for the coordination of the booking. Regulated certificates themselves are issued by the qualified provider under their own professional accreditation, and their content is a matter of professional judgment on the day of inspection.
All copyright and other intellectual property rights in the Deliverables (including photographs, floor plans, virtual tours and video assets) remain owned by Property Motion or its providers.
Once you have paid the Fees for a Booking in full, we grant you a perpetual, worldwide, non-exclusive, royalty-free licence to use the Deliverables for the purpose of marketing, letting or selling the specific property covered by that Booking. This licence includes use on:
You may not:
If you need a broader or exclusive licence (for example for a franchise or multi-property marketing pack), please contact us so we can agree terms in writing.
We may use Deliverables and anonymised property details in our own portfolio, case studies, website, marketing and social media, to demonstrate the quality of our work. We will not disclose confidential commercial information (such as sale price, achievable rent or vendor details) without your permission.
You can opt out at any time by emailing hello@propertymotion.co.uk with the subject line “Portfolio Opt-Out” and the property address. We will remove the relevant assets from our current marketing within a reasonable period and stop using them going forward.
Opt-out does not require us to recall printed materials already distributed or third-party republications already made.
When you provide us with content (for example photographs, floor plans, notes, descriptions, branding assets or logos) for use in a Booking, you grant us a non-exclusive, royalty-free licence to store, adapt and use that content solely for the purpose of delivering the Services and meeting our legal obligations. You confirm that you have the rights necessary to grant this licence.
All content on the Property Motion website, including copy, visuals, branding, logos, layout and code, is owned by Property Motion or licensed to us and may not be copied, adapted, distributed or used commercially without our written permission.
Content on our website is provided for general information only. We aim to keep it accurate but do not guarantee that it will always be complete, current or free from error. Nothing on the website constitutes legal, financial or regulatory advice.
Nothing in these Terms limits or excludes:
Subject to the above:
We recommend that you maintain appropriate insurance to cover any loss that may fall outside these limits.
We are not responsible for any failure or delay in performing the Services caused by events outside our reasonable control, including (without limitation) severe weather, natural disasters, fire, flood, power or internet outages, government action, industrial action, pandemic-related restrictions, or the unavailability of third-party providers. Where a force majeure event continues for more than 30 days, either of us may cancel the affected Booking without further liability, in which case we will refund Fees paid for Services not yet delivered.
If something goes wrong, please contact us as soon as possible at hello@propertymotion.co.uk with your Booking reference and a description of the issue. We aim to acknowledge complaints within 3 Working Days and to provide a substantive response within 15 Working Days.
If we cannot resolve a dispute informally, we will discuss with you in good faith whether alternative dispute resolution (such as mediation) is appropriate before either party commences court proceedings.
We process personal data in accordance with our Privacy Policy. Please review the Privacy Policy before using the website or booking Services.
We may suspend or terminate your access to the website or the Services, and cancel outstanding Bookings, with immediate effect if you:
Termination does not affect Fees already earned for Services delivered up to the date of termination, or any rights or remedies either of us has for prior breaches.
We may update these Terms from time to time. The latest version will always be available on our website with the effective date shown in Section 1.
For Bookings already confirmed, the Terms in force on the date the Booking was confirmed will continue to apply. Continued use of the website or new Bookings placed after an update means the updated Terms are accepted for those interactions.
Notices. Formal notices under these Terms should be sent by email to hello@propertymotion.co.uk or to the registered office shown in Section 1.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or subcontract our rights and obligations, including to group companies or trusted service providers, without your consent, provided this does not reduce your rights under these Terms.
Entire agreement. These Terms, together with the Booking confirmation and our Privacy Policy, form the entire agreement between us in relation to a Booking and supersede any earlier statements or arrangements on the same subject.
No third-party rights. A person who is not a party to a Booking has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term.
Severance. If any part of these Terms is found to be unenforceable, the remaining parts continue in force.
No waiver. A failure or delay by us to enforce any right under these Terms is not a waiver of that right.
These Terms and any Booking are governed by the laws of England and Wales. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts of England and Wales.
